TraceEagle User Agreement
Thank you for choosing TraceEagle. Please read this Agreement carefully and in full before use. We have highlighted in bold the clauses that most affect your interests (in particular Authorized Use, Prohibited Conduct, Risk Acknowledgement, Disclaimer, Limitation of Liability and Indemnification). By downloading, installing or using the Software in any way, you confirm that you have read, understood and accept this Agreement. If you do not agree, please exit and stop using the Software immediately.
1. Acceptance and Scope
In short: this Agreement governs your installation and use of the Software. Downloading, installing or using it means you agree; the Privacy Policy is part of it.
This Agreement is between you (the "User", "you") and TraceEagle / 抓包鹰 (the developer and provider of the Software, "we", "us") regarding your download, installation, activation and use of the Software. By downloading, installing or using the Software in any way, you are deemed to have read and agreed to this Agreement.
You confirm that you have full legal capacity to enter into and perform this Agreement. If you are a minor, read and use the Software only with the accompaniment and consent of your legal guardian. If you use the Software on behalf of an organization, you represent and warrant that you are authorized to do so, and this Agreement binds both you and that organization.
The separately published TraceEagle Privacy Policy forms an integral part of this Agreement and has the same effect as this Agreement.
2. Definitions
Software: the TraceEagle / 抓包鹰 client and its components, updates and documentation.
Capture: any functionality provided by the Software to observe or reconstruct network communications, including without limitation packet capture, proxying, TLS/HTTPS decryption, reading application-layer plaintext, removing certificate pinning ("unpinning"), process injection, installing root certificates, and replaying or modifying requests.
Target: the device, network, system, application, service, communication and data being captured.
Authorization: explicit permission from the owner or lawful controller of a Target allowing you to perform Capture on that Target.
License code: a licensing credential issued by us to activate the corresponding features of the Software.
3. Grant of License
In short: the Software is free; we grant you a limited license to use it yourself, and some features require activation.
Subject to your compliance with this Agreement, we grant you, free of charge, a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for lawful purposes.
Certain features may require activation with a license code and may be limited by your activation status; license codes are likewise issued free of charge.
The Software is for your own use. Your use of it does not make us a processor of your communications or data; for the data you capture, you are the sole controller and responsible party.
4. License Restrictions
In short: no reverse engineering, no reselling or sharing license codes, no defeating activation, and don't turn the Software into a service for others.
Except where mandatorily permitted by applicable law, permitted by the license terms of an included open-source component, or with our written consent, you may not: (a) reverse engineer, decompile or disassemble the Software, or otherwise attempt to derive its source code; (b) copy, sell, rent, distribute or sublicense the Software, or resell or share your license codes; (c) circumvent, crack or interfere with the Software's licensing, activation, verification or revocation mechanisms; (d) remove or alter any proprietary notices in the Software; (e) offer the Software as part of an automated service to third parties (for example, providing bulk capture or decryption services to the general public).
5. Authorized Use (Lawful-Use Precondition — Key Clause)
In short: only use the Software on Targets you own or are explicitly authorized to test. This is the most fundamental precondition of use.
You may perform Capture only on devices, networks, systems and applications that you own, or for which you have obtained explicit Authorization from the Target's owner or lawful controller.
"Capture" expressly includes, without limitation: decrypting HTTPS/TLS communications, reading application-layer plaintext, removing certificate pinning, injecting into processes, installing root certificates on a Target, and replaying or modifying requests — each of which must be performed within the scope of Authorization.
Before performing Capture, you are obligated to determine and ensure that the Target belongs to you, or that you have obtained all necessary Authorization for that Capture, and that it does not violate any applicable law, contract, privacy policy or third-party terms. The burden of proving Authorization is on you.
Features such as "unpinning / trusting the proxy certificate" exist solely to let applications you are authorized to test trust your own capture environment, and must not be used to gain unauthorized access to, or defeat the security measures of, others' systems.
6. Prohibited Conduct (Key Clause)
In short: never use the Software for unauthorized interception, intrusion, data theft or other unlawful purposes.
Regardless of whether it constitutes a crime where you are located, you must not use the Software for any of the following:
(a) intercepting, monitoring, recording or reconstructing the communications or data of others without authorization;
(b) accessing, intruding into, controlling, interfering with or damaging others' devices, networks, systems or their security measures without authorization;
(c) stealing or unlawfully obtaining others' personal information, privacy, account credentials, trade secrets or other protected data;
(d) circumventing the licensing, authorization, copyright protection or technical measures of others' software;
(e) committing fraud, network attacks, distributing malware, or any other unlawful or infringing activity;
(f) violating any law, regulation, industry rule or third-party agreement applicable to you or the Target.
7. Risk Notice and Acknowledgement
In short: the Software is powerful; decryption, injection, unpinning and the like can affect target systems. Use it carefully once you understand the risks, which you bear.
You understand and acknowledge that the Software is a powerful technical tool, and that features such as decryption, process injection, removing certificate pinning and installing certificates may, if used improperly, affect the systems involved or be used for improper purposes; whether the Software is used lawfully and properly depends on you.
The above operations carry a degree of technical risk and may affect the availability, stability or security of the Target device, application or network, and may even cause data corruption or loss.
If you use the Software on production or other important systems, please assess the risk beforehand and keep backups; any resulting damage or data-loss risk is borne by you.
8. User Responsibility and Undertakings (Key Clause)
In short: you are fully responsible for everything you do with the Software; we do not monitor it and cannot judge whether you are authorized.
You bear sole and complete legal responsibility for all of your conduct and its consequences in using the Software. Whether your Capture is lawful, authorized, or infringes third-party rights is for you alone to determine and answer for, and is unrelated to us.
You undertake to comply with Clauses 5 and 6. We do not monitor or review your use, and have no means or obligation to determine whether you are authorized. The Software is a neutral technical tool provided for lawful network debugging, security testing, troubleshooting, and research and study.
9. License Codes, Activation and Revocation
In short: activation needs online verification and binds to your device; it sends the license server limited, non-content information (see the Privacy Policy); abuse may lead to revocation.
Some features require activation with a license code. Activation may require online verification and binds the license code to your device.
During activation and use, the Software sends the licensing server limited information unrelated to your captured content (such as the license code, an anonymous device identifier and the software version); the scope and purpose of this collection are set out in the TraceEagle Privacy Policy.
If you breach this Agreement (especially Clauses 5 and 6) or abuse your license, we may revoke your license online and terminate the license grant. As the Software is provided free of charge, such revocation involves no refund.
10. Data and Privacy
In short: the data you capture stays on your device — we do not upload or access it; only activation, usage statistics and error reporting go online, and error reporting can be turned off.
All data you capture with the Software is stored only on your local device; we do not upload, collect or access it.
The information collected in connection with license activation, activity statistics, feature-usage statistics and error reporting is governed by the TraceEagle Privacy Policy. Error reporting is on by default and can be turned off at any time under "About → Error reports".
11. Software Updates
We may from time to time release updates, upgrades or patches through official channels. Once you obtain and install an update, this Agreement (or a new version provided with the update) continues to apply to the updated Software. Except where required by law or triggered by you, the Software does not install updates automatically without your knowledge.
12. Intellectual Property and Third-Party Components
The Software and its related intellectual property belong to us, and all rights not expressly granted in this Agreement are reserved. The Software may include third-party or open-source components governed by their own license terms; in case of conflict, those licenses prevail for the components concerned.
13. Disclaimer of Warranties (Key Clause)
In short: the Software is provided "as is"; we do not guarantee it will successfully, stably or safely capture or decrypt any particular Target.
The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, uninterrupted operation, freedom from error or absolute security. We do not warrant that Capture or decryption will succeed against any particular Target.
14. Limitation of Liability (Key Clause)
In short: the Software is completely free; to the maximum extent permitted by law, we have no liability for any loss connected with it (except liability that law does not allow to be excluded).
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, punitive or consequential damages (including loss of profit, loss of data or business interruption).
As the Software is provided entirely free of charge, to the maximum extent permitted by applicable law we shall have no liability to you, whether for compensation or otherwise, for any loss or damage arising from your use of, or inability to use, the Software.
This clause does not exclude or limit any liability that cannot be excluded or limited under applicable law, nor any mandatory rights you have under your local consumer protection law.
15. Indemnification (Key Clause)
In short: if your breach or use gives rise to a third-party claim or penalty, you handle it and hold us harmless.
If your breach of this Agreement, or your use of the Software, gives rise to any third-party claim, administrative penalty, litigation, demand or loss, you shall independently assume and resolve it and hold TraceEagle / 抓包鹰 and its developers harmless (including reasonable legal fees and enforcement costs); and you shall compensate us for any loss we thereby suffer.
16. Compliance and Export Control
In short: the Software contains encryption-related functionality; you must comply with your local laws on cryptographic software and on import/export.
The Software contains encryption-related functionality such as TLS/HTTPS decryption, which in some jurisdictions may be subject to laws on cryptographic software or on export control. Both you and we shall comply with applicable export, re-export and import laws and regulations.
You represent and warrant that you are not located in any country or region designated as embargoed or restricted under applicable law, and that you will not use the Software for any purpose prohibited by such laws. You are responsible for complying with all rules applicable in your location regarding the use, import and export of cryptographic software.
17. Changes to this Agreement
We may update this Agreement where necessary and will update the "Effective / updated" date at the top. For material changes, we will prompt you again in the Software and ask you to re-confirm your acceptance; your continued use after the change takes effect constitutes acceptance of the updated Agreement.
18. Termination
You may terminate this Agreement at any time by ceasing use and uninstalling the Software. If you breach this Agreement, the license terminates automatically and you must immediately stop using and delete all copies of the Software. Provisions that by their nature should survive termination (including Clauses 6–8 and 13–16) continue in effect after termination.
19. Governing Law and Disputes
You shall comply with all mandatory laws and regulations applicable to you and your location; all matters between you and a Target, or between you and third parties, arising from your use of the Software are your sole responsibility.
Any dispute arising from this Agreement should first be resolved amicably and in good faith through negotiation. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
20. Miscellaneous
This Agreement constitutes the entire agreement between the parties regarding the Software. It may be provided in multiple languages; in case of any ambiguity between versions, the Chinese version prevails.
